Social Media Privacy Policy

1. USER INFORMATION

Who is responsible for processing your personal data?

Comfort Aligners, S.L., with Tax ID Number B44774438, hereinafter referred to as the “CONTROLLER,” informs the USER that it has created a profile on the social media platforms Facebook, Instagram, Twitter, LinkedIn, YouTube, Vimeo, and Google+, and is the controller responsible for the processing of the user’s personal data carried out on said social media platforms. The CONTROLLER further informs the user that this data will be processed in accordance with the provisions of Regulation (EU) 2016/679 of April 27 (GDPR), and Organic Law 3/2018 of December 5 (LOPDGDD). Accordingly, the following information regarding the processing is provided:

Why do we process your personal data?

End of processing: maintaining a relationship between the USER and the CONTROLLER, which may include the following operations:

  • Process requests and inquiries submitted to the person in charge
  • Report on activities and events organized by the person in charge.
  • Provide information about products or services offered by the data controller
  • Interact through the official profiles

Why are we allowed to process your personal data?

Legal basis for processing: Article 6.1.a of the GDPR; the data subject has given consent to the processing of their personal data for one or more specific purposes. The USER has a profile on the same social network and has decided to join the CONTROLLER’s social media page, thereby expressing interest in the information posted there; therefore, when requesting to follow our official profiles, the USER provides consent for the processing of the personal data published on their profile.

The USER can access the social network’s privacy policies at any time and configure their profile to ensure their privacy.

The CONTROLLER has access to and processes the USER’s public information, specifically their contact name. This data is used only within the social network itself and will be included in a file maintained by the CONTROLLER only when necessary to process the USER’s request.

How long will we retain your personal data?

Data retention criteria: Data will be retained as long as the USER does not revoke the consent provided, as indicated in this privacy policy.

To whom do we disclose your personal information?

Data Disclosure: The information provided by the USER through the CONTROLLER’s social media accounts, including personal data, may be published—depending on the services the USER uses—and may therefore become publicly available to other third-party users of those social media platforms. From each social media profile, the USER can configure what information they wish to make public in each case, view the permissions that have been granted, and remove or deactivate them, just as they would with any third-party application they no longer wish to use.

No disclosure of personal data to third parties outside the social network is planned, unless if it is essential for the purposes of data processing, to our communications service providers, with whom the DATA CONTROLLER has entered into the confidentiality and data processor agreements required by current privacy regulations.

RIGHTS OF THE USER: These rights may only be exercised with respect to information that is under the control of the DATA CONTROLLER.

  • Right to withdraw consent at any time
  • Right to access, correct, transfer, and delete your data, and to restrict or object to its processing
  • The right to file a complaint with the supervisory authority (www.aepd.es) if you believe that the processing does not comply with current regulations

2. USE OF THE PROFILE

The DATA CONTROLLER will take the following actions:

  • Access to public information in the profile
  • Posting on the USER’s profile any information that has already been published on the CONTROLLER’s social media account
  • Send personal, one-on-one messages through the social media platform’s channels
  • Page status updates to be posted on the USER’s profile

The USER can always manage their connections, remove content that no longer interests them, and restrict who they share their connections with; to do so, they must access their privacy settings.

3. PUBLICATIONS

Once the USER becomes a follower or joins the CONTROLLER’s social media platform, they may post comments, links, images, photographs, or any other type of multimedia content supported by the platform. In all cases, the USER must be the owner of the published content, hold the copyright and intellectual property rights, or have the consent of the affected third parties.

Any posts on social media—whether text, graphics, photographs, videos, etc.—are expressly prohibited that violate or are likely to violate public morals, ethics, good taste, or decency, and/or that infringe upon, violate, or breach intellectual or industrial property rights, the right of publicity, or the law.

In such cases, the CONTROLLER reserves the right to immediately remove the content without prior notice and may request that the USER be permanently blocked.

The CONTROLLER shall not be held liable for content freely posted by a USER.

The USER should be aware that their posts will be seen by other users, and therefore they are primarily responsible for their own privacy.

Images that may be posted on the social network will not be stored in any file by the CONTROLLER, but they will remain on the social network.

4. INFORMATION ON MINORS OR PEOPLE WITH DISABILITIES

Children under the age of 14 are prohibited from accessing or registering through the CONTROLLER’s social media accounts. If the USER has special needs, the intervention of their parent or legal guardian, or their legal representative, will be required, along with a valid document proving such representation.

The CONTROLLER is expressly exempt from any liability that may arise from the use of social media by minors or individuals with disabilities. The CONTROLLER’s social media accounts do not knowingly collect any personal information from minors; therefore, if the USER is a minor, they must not register, use the CONTROLLER’s social media accounts, or provide any personal information.
